ZINN ATTEMPTS TO FOIL TOWN HALL MEETING

Apparently Jerry Zinn, President of the St. Augustine Shores Service Corporation, does not understand the definition of "Contract" nor does he understand the Florida Statutes as they relate to the right of owners to peaceably assemble.

On February 11, 2010, Mr. Kevin Dunne, on behalf of members of the St. Augustine Shores Service Corporation, reserved the main hall at the Riverview Club for a member's town hall meeting to be held on March 4, 2010 at 7:00 PM. On February 11th, President Zinn signed off on the request and presented Mr. Dunne with a contract stating that there would be no charge for the facility. At the time Mr. Zinn made the correct call because currently the Riverview Club is funded through homeowner's association fees and it has been inferred for years that this facility is a common element. In addition, Florida Statute 720.304 grants a right to homeowners to peaceably assemble in common areas or recreational facilities serving the community.

Well it appears that Mr. Zinn has received word that the Town Hall meeting called to address concerns by members of the community may not be favorable to him and now he is attempting to thwart the homeowner's irrevocable rights to voice such concerns.

On February 19, 2010, Mr. Dunne received a signed letter stating that the Service Corporation Board had met on February 17th and voted unanimously to overrule the free use of the facility as provided for in the contract initiated on February 11, 2010. In the letter received on February 19th and signed by Mr. Zinn, it states that the homeowners must pay $571.00 for the use of the hall.

Zinn is attempting to extort additional money from the homeowners for the use of a facility that is operated with your association funds and the property taxes are paid with your hard-earned money. What is most appalling is that Zinn is attempting to put the blame on his Board when no such vote happened! As I look at the agenda that was posted for the meeting on the 17th of February I can assure you that any discussion with regards to the Town Hall meeting was NOT posted on the agenda and it has been confirmed that no such vote took place.

This is just another example of the deceitful practices that our community has to endure at the hands of this ego-maniac. How can you respect an individual that continuously pawns off his own dirty deeds on others.

The meeting will go on and we hope to see all of you on the 4th of March at 7:00 PM.
